Terms of Service

1. Acceptance of Terms

By accessing or using the Hoppie Hoppie platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

2. Description of Service

Hoppie Hoppie is an online marketplace that connects sellers of second-hand building materials (including steel structures, greenhouses, industrial machinery and related items) with potential buyers across Europe. We act as a technology intermediary and are not a party to any transaction between buyers and sellers.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. Sellers must be invited by an administrator and must complete the account-activation process.

4. Seller Responsibilities

• Sellers are solely responsible for the accuracy, completeness and legality of their listings.
• Listings must accurately describe the item, its condition, location and asking price.
• Sellers must hold clear title to items listed and must not list stolen, counterfeit or prohibited goods.
• Sellers must respond promptly to enquiries received through the Platform.
• Sellers are responsible for all aspects of the transaction, including negotiation, payment and delivery.

5. Buyer Responsibilities

• Buyers are encouraged to conduct thorough due diligence before committing to a purchase.
• Buyers must arrange inspections, transportation and any applicable permits independently.
• Hoppie Hoppie is not responsible for the quality, safety or fitness for purpose of any listed item.

6. Prohibited Conduct

You may not use the Platform to:

• Post false, misleading or fraudulent listings
• Harass, threaten or abuse other users
• Scrape, copy or redistribute Platform content without permission
• Circumvent any security measures or attempt to gain unauthorised access
• Violate any applicable laws or regulations

7. Intellectual Property

All Platform content (excluding user-submitted listings) is the property of Hoppie Hoppie and is protected by copyright. Sellers retain ownership of their listing content but grant Hoppie Hoppie a non-exclusive, royalty-free licence to display it on the Platform.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind. Hoppie Hoppie makes no warranty that listings are accurate or that transactions will be completed successfully. We do not guarantee continuous, uninterrupted access to the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, Hoppie Hoppie shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Platform or any transaction conducted through it.

10. Termination

We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

12. Changes to Terms

We may revise these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.
